Review NotaryCentral's Terms of Service covering user responsibilities, privacy practices, and liability limits so you know the rules for accessing our tools.

These terms were updated and effective as of November 1, 2025.

1. Agreement

Thank you for selecting the Services offered by Digital Mountain Group LLC. This is a legal agreement ("Agreement") between Customer and Digital Mountain Group LLC. By accessing and/or using the service(s), you are agreeing, on behalf of yourself and/or your company, to be bound by the most recent terms of this Agreement. If you do not agree to the terms of this Agreement, do not access and/or use the Service(s).

This Agreement between Digital Mountain Group LLC, referred to herein and on this website as "NotaryCentral", "we", "our", or "us", and you governs your use of the website (www.notarycentral.org) including, without limitation, all content such as text, information, images, applications, templates, software, and other information, services, and materials (collectively, the "Service" or "Services").

The "Customer" shall mean the entity or person invoiced by NotaryCentral for use of the Service, and "you" or "user" shall mean a unique user of the Service whether a Customer or not.

  • Any separate terms for services, including ordering, pricing, or activation

We reserve the right to revise, update, and change this Agreement at any time. Continued use of our Services after modifications constitutes agreement to the new terms.

2. Your rights to use the Services and restrictions

You are granted a personal, limited, nonexclusive, nontransferable right to use the Services. You agree not to:

  • Provide access to the Services to third parties without authorization.
  • Reproduce, resell, or exploit the Services or underlying software.
  • Overload, disrupt, or abuse our systems.

Violation may result in immediate termination of your account.

3. Payment

For Services offered on a subscription basis, the following terms apply:

  • Payments are charged in USD when you subscribe.
  • Accepted methods include a valid credit/debit card or other methods we provide.
  • You must keep payment information accurate and updated.
  • Subscriptions renew automatically unless canceled in accordance with Section 6.

4. Account registration and security

You are responsible for maintaining the confidentiality of login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or breach. We are not liable for losses arising from unauthorized use of your credentials.

5. Subscription management

You may add, downgrade, or remove Services at any time through the account portal. Changes may affect billing amounts on the next cycle. Promotional pricing is valid only for the stated term and may revert to the then-current rate afterwards.

6. Cancellation and termination

You may cancel Services at any time. Cancellation becomes effective at the end of the current billing cycle unless otherwise stated. We reserve the right to suspend or terminate Services for violation of this Agreement, non-payment, or actions that place our platform or other users at risk.

7. Free trials and beta features

Trial access or beta features may be offered at our discretion and may be modified or discontinued at any time without prior notice. Trial access converts to a paid plan if you do not cancel before the trial period ends.

8. Modifications to the Services

We may enhance or modify the Services to improve functionality, address regulatory requirements, or maintain security. When practical, we will provide notice of material changes that negatively impact core functionality.

9. Availability

We strive for uninterrupted availability but do not guarantee that the Services will be error-free or uninterrupted. Scheduled maintenance, emergency updates, or factors outside our control may temporarily limit access.

10. Customer data

You retain ownership of data you submit to the Services. You grant us a limited license to host, copy, and process that data for the purpose of providing and improving the Services. You are responsible for securing appropriate consents from your customers or signers before storing their data within the platform.

11. Confidential information

Each party agrees to protect the other party's confidential information using reasonable safeguards and to use it only for purposes of the Agreement. Confidential information excludes data that is publicly known, independently developed, or rightfully obtained from third parties without restriction.

12. Compliance with laws

You are responsible for ensuring that your use of the Services complies with applicable laws, rules, and regulations, including notarial, privacy, and data security obligations in your jurisdiction.

13. Indemnification

You agree to indemnify and hold harmless NotaryCentral, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising out of your breach of this Agreement or violation of law in connection with your use of the Services.

14. Disclaimer of warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

15. Limitation of liability

To the maximum extent permitted by law, NotaryCentral's total liability for any claim arising out of or relating to the Services is limited to the amount you paid for the Services during the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, data, or business opportunities.

16. Governing law and venue

This Agreement is governed by the laws of the State of Florida, without regard to its conflict of law principles. The parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida for any disputes arising out of this Agreement.

17. Remote Online Notarization

  • Provision of Service: We provide remote online notarization functionality “as-is” without any express or implied warranties.
  • Identity Verification: Identity verification is conducted through Stripe’s Identity Verification service, but NotaryCentral makes no guarantee that these checks will prevent all fraud or that signers cannot circumvent verification.
  • User Responsibility: You, the notary and user, remain solely responsible for verifying identities, preventing fraud, and complying with all applicable laws in the notarial process.
  • Limitation of Liability: NotaryCentral will not be held liable for any fraudulent acts, unauthorized use of the platform, or circumvention of security measures by any party. For details, refer to Stripe’s Identity Verification Terms.
