- Gain familiarity with the organization of Florida’s RON statutes (Part II of Chapter 117) and what each major section addresses – from definitions and authority to perform RON, through procedures, recordkeeping, and standards [79] [80].
- Understand how RON interacts with other Florida laws: an online notarization that meets Part II’s requirements is legally equivalent to an in-person notarization for all purposes [73]. Similarly, remote witnessing done in compliance with RON rules satisfies any statutory witness requirements (notably referenced for electronic wills) [74].
- Learn about the rulemaking authority granted to the Department of State (§117.295) to adapt RON standards over time (covering technology, security, education, etc.) [75] [29]. This ensures the regulatory framework can keep pace with technological changes.
- Recognize the compliance roles of the Department of State: accepting applications and registering online notaries [81], maintaining public lists of active online notaries and their chosen RON providers [82], and receiving self-certifications from RON service providers annually [30]. These measures create transparency and accountability.
- Identify oversight and enforcement provisions: for instance, the Department’s authority to investigate notary misconduct (with up to 10-year jurisdiction over online notarizations) [72], and the ability to suspend or revoke commissions for violations, similar to traditional notary discipline procedures.
